Minutes—December 16, 2009
Roll Call
The Jasper City Council met in regular and closed sessions for the month of December on Wednesday, December 16, 2009 at 7:30 p.m. at City Hall. Council members present included Frank Shumard, Russell Selvey, Mike Smith and Josh Ghumm. Mayor Paul Nelson presided over the meeting.
Josh Ghumm moved and Mike Smith seconded the motion to advance citizen participation to the top of the Agenda. The vote was 4-0 in favor.
Citizen Participation
There were a number of citizens present, and Mayor Nelson invited citizen participation. Chris Mooney addressed the Council regarding recent incidents of fighting among local young people, some of whom are of legal adult age, and several juveniles. One such incident involved Mr. Mooney’s son. Mr. Mooney shared that he felt the case had not been handled correctly and asked the Mayor to check in to the matter. Several other individuals shared concerns about recent incidents of fighting and vandalism. Mayor Nelson explained that the local Police Department was working on these issues, and that he himself would look in to this further.
Opening of Bids on Old City Maintenance Barn, S. 4th Street
Frank Shumard moved and Russell Selvey seconded the motion to amend the Agenda to advance the opening of sealed bids for the old maintenance barn to this point in the meeting. The vote was 4-0 in favor. There were two sealed bids received, one from Charles Schlichting and one from Don Kuiken. Bids were as follows: Charles Schlichting—bid of $9500.00 and Don Kuiken-bid of $15,000.00. Mr. Schlichting was present and did share that he would exercise his option to raise his bid, offering a bid of $15,025.00. Russell Selvey moved and Frank Shumard seconded the motion to table further discussion and discuss this in closed session. The vote was 4-0 in favor. Mayor Nelson shared that the Council would acknowledge Mr. Schlichting as the apparent high bidder, and that the Council would deliberate during closed session and advise the bidders of their decision.
Monthly Reports
The minutes of the November 18, 2009 regular and closed sessions and the December 3, 2009 special closed session were approved on a motion by Russell Selvey, seconded by Frank Shumard. The vote was 4-0 in favor. The Treasurer’s report for the month of November was approved as presented on a motion by Josh Ghumm, seconded by Mike Smith. The vote was 4-0 in favor. The Collector’s report for the month of November was approved as presented on a motion by Russell Selvey with a second by Josh Ghumm. The vote was 4-0 in favor. The obligations for the month were approved for payment with the addition of one invoice from Etcheson Construction (manhole installation—funds to be drawn from Water and Sewer Savings) on a motion by Russell Selvey, seconded by Frank Shumard. The vote was 4-0 in favor.
Departmental Reports
Water and Streets
Mayor Nelson shared that the manhole installation project had been completed by Etcheson Construction. The transfer switches for the generators were ready for use, and the striping had been completed on Grand and Main.
Fire
Mayor Nelson shared that the funds for the FEMA grant to the Fire Department for a new breathing air station had been received.
Police
The report of activities for the month had been prepared and presented in written form and was reviewed by the Council.
Accounting and City Hall
One request for sewer discount was received. Mike Smith moved and Frank Shumard seconded the motion to approve a sewer discount as requested by Charles Walters due to an outside water leak. The vote was 4-0 in favor.
City Clerk Mary McNary shared that bid invitations for annual audit had been sent. Bid opening is scheduled for regular January meeting date.
Old Business
Ordinance to Execute Solid Waste Contract
Russell Selvey moved and Frank Shumard seconded the motion to have the first reading of Council Bill #2009-6, by title only. The vote was 4-0 in favor. Clerk read the bill by title: A Council Bill/Ordinance authorizing the Mayor of the City of Jasper to Execute a Contract for the Hauling and Disposal of Solid Wastes From Residential Units in the City of Jasper, Missouri. Roll call vote was as follows: Selvey-yes, Shumard-yes, Smith-yes, and Ghumm-yes. Mike Smith moved and Josh Ghumm seconded the motion to have the second reading of Council Bill #2009-6, by title only. The vote was 4-0 in favor. Clerk again read the bill by title. Roll call vote was as follows: Selvey-yes, Shumard-yes, Smith-yes, and Ghumm-yes.
Administrative Hearing Commission
City is awaiting receipt of transcript of hearing.
Pending Property Purchase
Mayor Nelson had met with the MoDOT representative and presented the offer made by the City. Response by MoDOT is to be forthcoming.
Nuisance Abatement
A number of additional letters have been sent out, and residents continue to work on this.
New Business

Planning and Zoning Requests
None.
Plumbing Code/Building Codes
Discussion was held regarding adoption of the International Plumbing Code and the National Building Code. Several samples were reviewed. Codes will be reviewed further and discussed at more length at a later date.
Closed Session
Russell Selvey moved and Mike Smith seconded the motion to go into Closed Session to discuss the leasing, purchase, or sale of real estate by a public governmental body, pursuant to Chapter 610 of the Revised Statutes of Missouri with a closed record and a closed vote within that closed meeting. The vote was 4-0 in favor. The Council went into Closed Session at 8:53 p.m.
Discussion was conducted (pending property sale). During Closed Session there were no votes cast.
Frank Shumard moved and Russell Selvey seconded the motion to return to regular session. The vote was 4-0 in favor. Council returned to regular session at 9:03 p.m.
Russell Selvey moved and Mike Smith seconded the motion to reject all bids on the old City Barn property on south 4th street and table the issue for a couple of months. The vote was 4-0 in favor.
Mike Smith moved and Josh Ghumm seconded the motion to adjourn. The vote was 4-0 in favor. Meeting adjourned at 9:10 p.m.
