Minutes—November 18, 2009
Roll Call
The Jasper City Council met in regular and closed sessions for the month of November on Wednesday, November 18, 2009 at 7:30 p.m. at City Hall. Council members present included Frank Shumard, Russell Selvey, Mike Smith and Josh Ghumm. Mayor Paul Nelson presided over the meeting.
Review of Bids for Solid Waste Disposal
Representatives from three of four companies that submitted bids were present to answer questions or discuss their bid with the Council. Russell Selvey moved and Josh Ghumm seconded the motion to amend the Agenda to advance the discussion of Solid Waste Bids to the first item of business. The vote was 4-0 in favor. Bids submitted were as follows:

Discussion was conducted. Russell Selvey moved to accept the bid of Country Side Trash Service, with dumpsters to be provided for use at the City Barn and ball fields, (per current contract). The motion died for lack of a second. Mike Smith moved and Josh Ghumm seconded the motion to accept the bid of C & R Disposal, for a three year contract. The vote was 2 yes, 1 no, and 1 abstaining. Frank Shumard moved and Russell Selvey seconded the motion to add a 25 cent per month administrative fee to each bill for administrative expenses, including the annual large item clean-up. The vote was 4-0 in favor.
Monthly Reports
The minutes of the October 22, 2009 regular session were approved on a motion by Josh Ghumm, seconded by Frank Shumard. The vote was 4-0 in favor. The Treasurer’s report for the month of October was approved as presented on a motion by Mike Smith, seconded by Josh Ghumm. The vote was 4-0 in favor. The Collector’s report for the month of October was approved as presented on a motion by Russell Selvey with a second by Josh Ghumm. The vote was 4-0 in favor. The obligations for the month were approved for payment with the addition of one invoice from the appraiser ($1500.00) on a motion by Josh Ghumm, seconded by Frank Shumard. The vote was 4-0 in favor.
Citizen Participation
There was no citizen comment.
Departmental Reports
Water and Streets
Water and Street Superintendent Rick Good was present to discuss several items of business. Rick reviewed with the Council a cost estimate for striping on West Grand and on Main, at three corners of the intersection of Grand and Main. Discussion followed. Two “handicapped” designated parking spots and additional striping to be added to the original estimate should cost an additional $100.00. Russell Selvey moved and Josh Ghumm seconded the motion to accept the estimate from Zebra T Striping, with additions not to exceed $100.00 for a total cost of $542.00. The vote was
4-0 in favor. Rick will also talk further with this firm regarding a cost estimate for the sealing of cracks in the asphalt on Grand between 4th street and First street.
Rick shared that there are a number of sewer lines that are inaccessible for clean out because of the absence of manholes. Three bids had been received for the installation of five manholes. The Council reviewed bids from Hillbilly Pumping-($15,325.00), Wampler Plumbing-($13,700.00) and Etcheson Construction-($12,500.00). Discussion followed. Russell Selvey moved and Josh Ghumm seconded the motion to accept the apparent low bid of Etcheson Construction. The vote was 3 in favor with one abstaining (Mike Smith).
Rick reviewed with the Council a number of estimates for the installation of transfer switches at the wells and lagoon. These are necessary when the generators must be used. Frank Shumard moved and Josh Ghumm seconded the motion to accept the bid of Bill’s Electric, at $6989.00 for furnishing and installing (3) manual transfer switches and all necessary wiring. Also (2) sets of cables, 20’ long each. The vote was 4-0 in favor. Other bids included: Bishop Controls-$30,564.00 for 3 switches, C & M Electric-$11,550.00 for 2 switches, Joplin Electric-$8578.41 for 2 switches, and Webb Electric-$6,000.00 (2 switches).
Rick explained that he had compiled a list of street signs that are missing and need to be replaced. Estimated cost of the signs and hardware for replacement was $1822.00. Rick asked the pleasure of the Council in this regard. Russell Selvey moved to replace the signs per the list. Josh Ghumm seconded the motion. The vote was 3-1 in favor.
Discussion was held regarding the need for grease traps at local establishments (other than private homes) which serve food, and thus have waste grease to dispose of. Clerk was directed to prepare an amendment to the current ordinance to include under sink grease traps.
Russell Selvey shared a request from Alford Taylor to abandon the alley west of his property at Third and Mercer. This north/south alley has been platted but never used as an alley, and is blocked by a structure at the south end. Discussion was held. Consensus of the Council was to abandon the alley, but maintain the utility easement. Clerk will prepare an Ordinance for Council approval of abandoning of this alley.
Mayor Nelson reported that he had observed that damage is being done to the concrete approach to the alley on the south side of the Methodist Church by those vehicles dragging on the approach. Consensus of the Council was to contact the contractor who did the previous work at this location (Reed Concrete) and cut down the approach.
Fire
Fire Chief J.R. Good shared that the Department had been busy with routine calls for service. Other items to report included:
1. The replacement rural brush truck is ready for service.
2. The Department has received a 10 KW diesel generator from the Department of Conservation.
3. Plans are underway to purchase GPS units for the trucks, these are very accurate and are especially helpful where there are no signs or house numbers, or on calls after dark in unfamiliar territory. At meeting time one of these had been donated.
4. The Department has a Medical Director, and Medical Protocols have been prepared.
5. The Loren Griggs family designated that memorials be given to the Fire Department for medical equipment. Current plans are to replace an aging defibrillator with these funds.
6. Carthage has named Jasper for automatic mutual aid, replacing Carterville. Carthage will help provide some local training.
Councilman Selvey added that Mrs. Griggs had expressed her appreciation for the work of the First Responders, and shared that we have a Fire Department to be proud of.
Police
Acting Police Chief Jeffrey Prater reported that the Police Department responded to 43 calls during the month of November. He has been working on removing stray dogs and pit bulls, per the new ordinance. Jeffrey shared that Patrolman Craig Peek has stayed with the Department, and he will be adding one more part-time officer.
Accounting and City Hall
City Clerk Mary McNary presented the Council with an updated budget, through October 31, 2009. Discussion was held.
Old Business
Administrative Hearing Commission
Mayor Nelson shared that he and City Attorney James Spradling had attended the hearing, and are still hopeful that the City will prevail. A transcript of the hearing will be provided to the City, and a post-hearing brief must be prepared and submitted. The final answer will come after submission of the post-hearing brief.
Pending Property Purchase
An appraiser has been contacted by the City to complete appraisals of the old City Barn property and the MoDOT property.
New Business
Business License Requests
None.
Planning and Zoning Requests
Two requests for permit had been reviewed and recommended for approval. These included an addition on the home of Billie Ann Percy, and the construction of a dog pen at 410 E. Grand, (Chris Mooney). Frank Shumard moved to approve both permits and Josh Ghumm seconded the motion. The vote was 4-0 in favor.
Closed Session
Russell Selvey moved and Frank Shumard seconded the motion to go into Closed Session to discuss the hiring, firing, promotion, disciplining and compensation of personnel pursuant to Chapter 610 of the Revised Statutes of Missouri with a closed record and a closed vote within that closed meeting, and to discuss the leasing, purchase, or sale of real estate by a public governmental body, pursuant to Chapter 610 of the Revised Statutes of Missouri with a closed record and a closed vote within that closed meeting. The vote was 4-0 in favor. The Council went into Closed Session at 9:43 p.m.
Discussion was conducted—(Police personnel) and (pending property purchase). During Closed Session there were no votes cast.
Frank Shumard moved and Josh Ghumm seconded the motion to return to regular session. The vote was 4-0 in favor. Council returned to regular session at 10:35 p.m. Frank Shumard moved and Josh Ghumm seconded the motion to appoint Jeffery Prater as Chief of Police, at $11.50 per hour. The vote was 4-0 in favor.
Josh Ghumm moved and Frank Shumard seconded the motion to adjourn. The vote was 4-0 in favor. Meeting adjourned at 10:40 p.m.
